Yes, I agree,  approaching your NIH contract specialist to request subcontracting out would be the cleanest way to "move" the work with the transferring PI to a new institution.

You asked for regulatory references and in the FAR points to how to obtain Government's consent for the sub:

 Subchapter G - Contract management Part 44 on subcontracting out (44.202-2)

We did it by naming a new PI at our institution, getting NIH permission to do it and subcontracted out to old PI at his new institution.
