My question, does your university purchase this above referenced policy?
Our Risk Management Office has passed on an article obtained from the
URMIA Report which is published by the University Risk Management and
Insurance Association. The article was about the Defense Bases Act,
which is a Federal Workers' Compensation Program, an extension of the
U.S. Longshoreman's and Harbor Workers Act.
It is designed to protect employees 1) working for the federal
government on U.S. military bases, 2) working upon lands occupied by the
United States outside the continental U.S., 3) working in any public
work in any territory or possession outside the United States, and 4)
under any contract with the United States or any agency where such
contract is performed (in whole or part) outside the continental U.S.
and places not covered by (1), (2) & (3) (e.g., USAID contracts, State
Department contracts, or any Foreign Assistance Act contracts). The Act
covers U.S. citizens, local nationals and third country nationals. The
act also covers subcontractors of any prime contractor.
If any of these conditions apply, the university must have the Defense
Bases Act insurance coverage. If you don't, the university can be held
responsible for the injury if the contractor has not obtained the
coverage and you cannot pay the claim.
The penalty for noncompliance is a fine of $10,000 and/or one year in
jail for the President of the University.
The article stated that the individuals should contact their sponsored
programs office.
