Does anyone know what, if any, facilities and administrative costs rate
 is to be used for an institution (e.g., a hospital) that does not have a
 negotiated rate?  We are currently subcontracting to a for-profit hospital
 that claims that their rate is 40% but they do not have enough Federal
 funds to require negotiating a rate and have no back-up for using this
 rate.  They claim they have been using this rate for several years as a
 subcontractor on Federal awards.  Does NIH check the rates applied to
 subcontractors?  What liability do we have to assure that the rate they
 are charging is correct?  Please respond directly to me or to the listserv.
