 As a follow up to my previous response, the Act DOES not generally apply to R&D
 effort even if services employees are used.  For example, the R&D effort may
 required the use of computers which are to be maintained by computer repair
 personnel (service employees) but the Act would not be applicable.

 Bottom line, R&D does not generally come under the Act.
