I think that many institutions have a "don't ask, don't tell" policy
regarding this very messy issue.  When I have raised it with some of the
deans here, they all realize that some faculty make use of their
institutional resources to benefit their consulting but there is not a
clear sense as to what we should do - the bottom line is that we have a
policy that clearly states that if you use university resources, it is a
university project; yet, this is never pursued (we would be viewed as being
hostile) - when we do find out about things it is usuually through some
indirect method (a newspaper article, a mysterious check that was
inadvertently sent to the university, etc.).  I look forward to hearing how
other places handle this sensitive issue.
