Fees or Profits under Grants/Cooperative Agreements Norman Meeks 18 Jul 1995 08:31 EST

I am researching an issue that may be of future interest to a number of you.
The issue I am researching has to do with the availability of fees or profits
under grants or cooperative agreements.  The DRAFT of the DoD Grant and
Agreement Regulations (DoD 3210.6-R) carries a provision that prohibits
the payment of fee or profit to a recipient under a grant or cooperative
areement and prohibits the award of such a document if the payment of a
fee or profit is necessary to achieve the program objectives.

I have attempted to trace the gensis of this provision but have been
unsuccessful.  The closest that I have been able to come is a reference in
the response to public comments at the reissuance of the new A-110.  In
the response, there was a reference to a comment for clarification on the
use of a fee or profit that there was no change in the circular; fee or
profit would be available ONLY IF AUTHORIZED BY STATUTE.

Note that I am not talking about fees or profits under CONTRACTS with
colleges/universities/non-profits.  Fees have and are available under
contracts (although possibly restricted) with these organizations.
