NCHRP Liability Statement

I am curious to see what other universities think about and how they deal
with the NCHRP liability statement that we are required to sign for our
proposals to be considered. The language places all the risk and expense
on the contractor/recipient and none on NCHRP. In order for the contractor
to share with NCHRP the expense associated with a claim, we have to find
that NCHRP was grossly negligent. This is difficult to prove. In order
for the contractor to be responsible for expenses, a claim must be filed.
No judgement is required. We have signed these forms in the past but would
like to address this further with NCHRP. The work we do for them and that
they sponsor for others is essential to the Highway infrastructure of the
nation, however, it seems we could work together without so much exposure
for the Universities involved. Any ideas, comments, advice, or war stories
are appreciated.

PS. We find it surprising that the National Academy of Sciences would
allow this.
