What cost principles do you operate under? If it’s A-21, then the F&A rate in effect at the time of the award continues for the life of the award, even if the negotiated rate subsequently changes. If it’s A-122, the rate can change, but there may be a saving provision against a retroactive rate change.

Subject: [RESADM-L] F&A Question
Hi All,
Been wrestling in my head with an F&A question I haven't encountered previously. Say we received an award issued on 7/09/12 that used the indirect cost rate agreement in place at the time 80%. Subsequently we receive a new rate agreement of 75% dated 7/10/12 but with an effective period starting 6/10/12. The NoGA was issued using the agreement in place at the time of award, but I'm not sure if the subsequent agreement's retroactive effective period supercedes this… Any thoughts?
