We are looking at the definition of Business Enterprise/Person to see if that gives us some leeway as a public, not for profit. I will let you know...but will also be interested in what others have to say. In addition, we have very few contracts, as opposed to grants but hope to change that in the future so will still need to determine applicability to our institution.

Our controller forwarded the forms found at the website below to me for review. Apparently, this is a new government requirement due June 30th. It appears to require the information for line items that exceed $2M in receipts (or payments) to/from foreign persons and one of the line items is #29. Research and Development Services. Their definition of “services” includes “Rights to use, copy, distribute, or acquire or sell intellectual property such as patents, trademarks, copyrights, formulae, etc.” It appears this will require documentation of research contracts (grants are excluded) with foreign entities.
Have any of you seen/heard of this? Do you know of any exemptions/exceptions for universities? Who at your institution is completing this? Or am I interpreting this incorrectly?
