Has anyone else had an issue with this term and condition for a DOJ award?

First email:

Request removal of the last paragraph of Article 22 for “RECOVERY ACT –
Separate Tracking and Reporting of Recovery Act funds and Outcomes” which
states:

 “The recipient further agrees that all personnel (including sub recipient
personnel) whose activities are to be charged to the award will maintain
timesheets to document hours worked for activities related to this award and
non-award related”

Justification for removal:
The administrative policies for timekeeping at University are in accordance
with Circular OMB A-21 “Cost principles for Educational Institutions” where
costs are incurred and certified as a percentage of effort.

Response:

I am positive that we will not be able to remove any special condition.
However, we may be able to provide something in writing with regards to your
method of tracking time.  I will get back to you.

Todays response to followup:

I have not heard anything from our Office of General Council yet.  But, I would
say be prepared for the possibility of having to derive some sort of time sheet.
