Re: IP ownership - industry-sponsored clinical trials

It's been our experience that it's very difficult to negotiate IP rights when the sponsor both owns the product and wrote the protocol. We do, however, try not to let the sponsor define their IP so broadly that we'd have to cut off the PI's head in order to comply! . . . or reach-through language that might affect research we do with the product after it's approved down the road.
If it's our protocol, we expect to own IP resulting from it but can offer a license to the sponsor.

Only when there is new discovery / unanticipated that university could
negotiate partial /shared IP. Would like to hear what others'
experience.

Subject: [RESADM-L] IP ownership - industry-sponsored clinical trials
Dear Colleagues,
Do you accept the ownership of IP by the sponsoring company on clinical
trials? In other words, are you always successful in negotiating the
university ownership of IP?
Thanks for your input,
Zoya
