Interest on a Federal Award

Here is a question to chew on:
We were a recipient of a federal award, but at the time we got it we were a "college" underneth a "university" umbrella. After the award was made to the university, we were granted independence by the legislature. We transferred most of what was left the "award" (really it was a matter of record and paper as most all the direct costs were spent), but the policy of the university was to only distribute back to the college/PI of the award (10% to each with the remaining being retained in central sponsored research) only once per year for the prior fiscal year. Let me give you a date example to clarify: FY05 (7/1/04 to 6/30/05) F&A would be "distributed" in December 2005.
Okay... that is the set up... now the question... because it is their "policy" to distribute the F&A as they themselve prescribe, and we have invoiced them for the amount owed to us, could we charge them interest for late payment? For those of you who have had "bad" transfers of NIH or NSF awards to another institution, what have you done to resolve?
