Fixed Price exempt from A-133?

I am reviewing a fixed price federal flow through subcontract where there is
mixed language (cost reimbursement/fixed price) from the prime.
A fixed price billing rate per patient contract would be exempt from A-133,
correct?
I am unable to find this in writing.
Would OMB Circular A-21, A, 3, "shall be used as a guide in the pricing of
fixed price contracts..." and A 3C, "Other awards under which the
institution is not required to account to the Federal Government for actual
costs incurred" be enough to support this?
