Check out the following site for a very nice decision tree: http://grants1.nih.gov/grants/policy/hs/PrivateInfoOrBioSpecimensDecisionCha rt.pdf If the information is data or specimens that have already been collected, are unidentifiable, publicly available, canot be linked to a specific individual etc. than it is not human subjects research, even if the subjects are still alive. If it is data on deceased individuals, the decision tree says it is not human subjects research. So, you would check "no" for human subjects.
