We've encountered this situation in a number of forms--a person whose relationship with the institution is something other than employee wants to serve as PI. Examples include alumni; retired scientists from other schools who collaborated with our PIs before they retired; former faculty members who've gone into private practice or other employment; faculty members at other schools who want to apply for grants which their employer is not eligible; faculty members at other schools with "joint" or "adjunct" appointments at our school. The answer is that you have to be an employee--but it's wise to have a written policy that defines who is eligible to serve as a PI (for example, what about employees who don't have faculty appointments? What about part time faculty? etc. etc.) And once when I posted the same question to this discussion group, one respondent told me about something called an "agency agreement"--an agreement between the institution and an individual that confers whatever privileges the parties agree to for some limited duration. Without having the employee/employer tie, you have no leverage if a problem arises. Additionally, your institutional insurance probably would not extend to the person. He wants to serve as an institutional PI, but we do not allow that since he is not an employee. He can be the PI for his own practice and then subcontract for the services he needs from the health system. Is there a federal regulation regarding this situation or has anyone else had experience?
