Indemnification Language - A.Ward Ford Memorial Institute Grant Beyea, Donna L. 15 Jun 2005 10:57 EST

Can anyone tell me if they have submitted an application to the American
Society for Laser Medicine and Surgery, Inc. for an A. Ward Ford Memorial
Institute Grant?

They require the following indemnification agreement to be signed as part of
the proposal:

"The undersigned agrees that it will at all times protect, indemnify, save
and keep harmless the ASLMS and its members, officers, directors, employees,
and agents from and against, and shall reimburse them for any and all loss,
claim, liability, damage, judgment, penalty, injunctive relief, injury to
person, property, or natural resources, costs and expenses (including legal
fees) arising out of or in connection with any activity conducte4d as a
result of the award to the undersigned by the ASLMS."

They refuse to modify this in any way and I'm being told (of course) that no
other institution has raised this as an issue.  I've even asked, as a
minimum to limit the indemnification by adding "except to the extent caused
by the acts or omissions of ASLMS" and they won't budge.

 I'm curious as to whether or not anyone submitting to this program is aware
of this clause and has concerns as we do or might it be that your PI's
signed this without Institutional knowledge as mine initially tried to do.
