Nondiscrimination statements Ted Mordhorst 07 Oct 2004 14:05 EST

I can't believe I am going to the list twice in a row but you all have been
so helpful to others that I thought I should tap into your collective wisdom
more often.

We recently received a joint venture agreement from the USDA-Forest Service
that contains a requirement for our nondiscrimination statement to contain
specific language as shown below.

"...  The nondiscrimination statement which follows shall be posted in
primary and secondary UI offices at the public service delivery contact
point and included in full on all materials regarding UI's programs that are
produced for public information, public education, or public distribution:
"In accordance with Federal law and U.S. Department of Agriculture policy,
this institution is prohibited from discriminating on the basis of race,
color, national origin, sex, age, or disability. (Not all prohibited bases
apply to all programs.) To file a complaint of discrimination, write USDA,
Director, Office of Civil Rights, Room 326-W, Whitten Building, 1400
Independence Avenue, SW, Washington, DC  20250-9410 or call (202) 720-5964
(voice and TDD). USDA is
an equal opportunity provider and employer."

The university already has a nondiscrimination disclosure statement which is
displayed and used as instructed above but it is not a direct quote of the
above statement.  I sent a copy of our current statement to the contracting
officer and asked,
"Do we need to change our statement to add the specific language above in
order to be in compliance with this clause?"

Their response was that we need to comply with the contract clause.

Have others run into this and if so how did you deal with it?  Any
suggestions would be appreciated.
