We pay overtime as long as it's documented and reasonable.  Most of our funding is NIH grant funds or corporate clinical trial contracts.  We've never had a problem with it.

The new NIH Grants Policy Statement says the following regarding overtime:

"Premiums for overtime generally are allowable; however, such payments are not allowable for faculty members at institutions of higher education.  If overtime premiums are allowable, the categories or classifications of employees eligible to receive overtime premiums should be determined according to the formal policies of the organization consistently applied regardless of the source of funds."

So... once again, one must follow their own policies consistently, thus if a person would be eligible for overtime if they were not paid from a grant, they would be eligible if they are paid from a grant, and vice versa.  Faculty are exempt, so they are not eligible... but then, we are compensated in our annual contracts accordingly.

The key is to thoroughly review the personnel positions named on grants and determine if you have anyone that is non-exempt that perhaps should be exempt based on your institutional criteria.

 Colleagues:

 The University of Montana has a number of temporary and
permanent employees who are non-exempt and paid from grants.  During the
field season many of them work overtime hours in order to collect the
necessary data within a viable window of opportunity for each project's
focus.  Our office has always felt that any overtime charges on grants
are unallowable under the language in J.8.d.1.

 Our questions are as follows:

 -          Do other institutions allow overtime charges against
sponsored projects?  If so, what basis do you use to support your
position?

 -          Has your stance passed an audit?
