Graduate Student Tuition and Fees

Dear fellow research administrators, I hope you will help me answer a
question that has come up here.
The question involves our practice of paying graduate assistant fees from
sponsored agreements.
A little background first. All in-state graduate students have their
tuition waived, out of state graduate students with an Assistantship have
their tuition waived that leaves only their fees to be paid. These fees
including health insurance total about $5,000 per academic year. DHHS has
deemed these fees equivalent to tuition and exempt them from F&A charges.
The question is, can we pay these fees on federal grants and contracts if
they are not considered part of the assistantship compensation package?
If not and they must be considered part of the compensation package (A-21
J41) to be allowable, do we need to pay the fees for GAs from non-grant
funds for assignments not on grants?
