We've been seeing some form of the language shown below in clinical trial
agreements, and I'm wondering if anyone on the list knows what the purpose
of this language is?  We try not to get into a situation of accounting for
costs of clinical trials . . . just receive a fee per patient; so this
language is problemmatic.  I'm having a hard time understanding the purpose
so that I can propose alternate language.  I suspect it has to do with
government rights to inventions, but I'm not sure.

The agreed upon payment represents all direct and indirect costs associated
with conducting the
 Research, including all overhead and infrastructure costs.  Insitution
agrees not to utilize any additional source of financial support for any
part of the Research.  Institution represents that no funding provided to
Institution or Investigator by the United States Government, or any agency
thereof, including financial support of a general nature, will be used to
conduct any part of the Research.
