DOD Requirement that Medical Care be Provided to Research Subject s at No Cost Paplauskas,Leonard 25 Jul 2002 06:55 EST

We have received an amendment to an already existing award agreement from
the Army under the Congressionally Directed Medical Research Programs.  The
Amendment requires that we either agree to provide free medical care to any
individual who experiences injury or illness that is a direct result of
participation in the research, or that we obtain insurance coverage
sufficient to cover all such costs.

The direct payment of subjects is contrary to the Connecticut Claims Against
the State statute, and Connecticut's insurance purchasing group has been
unsuccessful in obtaining quotations for coverage for this purpose.

Have other institutions, particularly other state institutions, been
contacted by DOD requiring amendment of existing agreements to include this
new requirement?

Have other institutions been successful in obtaining the insurance required
by the DOD policy?
