David; I'm not sure I understand the situation but will try to answer based what it appears you are asking. Presumably you will/have obtain(ed) NIH approval for the subagreement. Yes, your institution will be entitled to your F&A rate on the first $25k, however since it was an unforeseen event (at least perhaps institutionally)there may be fundamental budget issues. If the PI made a strong argument that the additional F&A would negatively impact the project we would consider negotiating the total F&A that our institution and the sub-recipient institution would recover. In the past we have usually been successful in negotiating something in relation to the rates of the two institutions and the balance of the F&A remaining from the original budget.
