Please don't assume that universities who have accepted this language have
done
so with "no problem". It is a truly complicated issue. The DFARS allow the
sponsor to identify information as sensitive and there is no easy prescription
to use to get out of the clause. NSDD 189 says that if the project is that
sensitive then it should be classified. Some schools don't do classified work
and getting sponsors to agree to NSDD 189 and disagree with the DFARS when the
one is more favorable to them is complicated. There is nothing legally wrong
with them requesting a restriction on the release of information. Our problem
is that if they do so, we have to deal with export control issues. Those
issues are complicated too and quite time consuming. The risk of
non-compliance is high.
Many of us have taken difficult language when it was politically incorrect not
to do so or we couldn't find a legal prohibition against accepting it.
Therefore, maybe we should request assistance with this from COGR and band
together to educate each other instead of assuming some of us are "caving in"
to the detriment of others.
