Our approach is to consider the apparent intent. Typically your first two
examples would qualify as gifts, if there are no other commitments the
University has to make in order to meet its fiduciary responsibilities;
e.g., at most a written concurrence that funds will be applied as
specified, but no detailed fiscal reporting. The last example is language
that often presages restrictions that change it from a directed gift to a
sponsored program, so the total language needs to be considered.
When faculty ask for guidance in the language they can advise a donor of a
gift, we suggest:
"A gift to support ...[direction ]... as the University's discretion." We
get support like this that can be very important to an individual, lab, or
department. Something with a broader target than these should probably be
referred to Advancement (or whatever your institution calls its gift
activity) because of the need to coordinate with school- or
institution-wide targets.
