your first option is what I have in mind. Yes, you are absolutely right that
this is still informal and probably too early for a legalistic document. Our
organization is a small non-profit community hospital and has only recent
experience in grant funding, certainly no NIH experience to date. We do have
a history of collaboration with the organizations we wish to include in an
application for the HRSA Rural Health Network, but as yet not formal
agreement document exists to describe these mutual activities.
We want to keep it simple for several reasons, not the least of which is
that our experience has taught us not to start the discussion with a draft
from the lawyer. The collaborating organizations are often intimidated by
this, and it does not help build trust. Such an approach often results in
the very negative intepretation that the "big, powerful" local hospital
"with all its money" is trying to take advantage of us little organizations.
The sample agreement of the most basic type is what I am seeking at this
point. It is possible that if the network is granted funds from HRSA we may
some day consider moving toward a more formal, legal entity, but this is not
our intent at this time.
