Yes they can.  However, they will need to submit an independent
contractors agreement.  I process check requests over here at Henry
Ford and I see that being done all of the time.  You will also need to fill out
a 8233 form (Exemption from witholding on compensation for
Independent personal services of nonresident alien individual).
