For Ohio research administrators -- Commission on Minority Health

Dear Colleagues:
The University of Akron recently received an award from the Commission
on Minority Health, an agency of the state of Ohio.
The terms and conditions contain an indemnification clause, which the
Commission deleted per our request, and a clause requiring the
university to seek the Commission's permission prior to asserting
copyright (or patenting) for any intellectual property developed under
the award. We asked them to remove this clause since it is inconsistent
with our policies. We also noted that the university is also an
instrumentality of the state and has a policy of providing other state
agencies with a royalty-free license to any deliverables developed under
awards. They refused to delete the clause.
I wanted to know if any other Ohio universities have had recent awards
from the Commission and whether anyone successfully negotiated more
acceptable language for the copyright clause. (Anyone from Ohio State
out there????)
