The court decision is Stanford vs. Sullivan, 773 F. Supp. 472 (D.D.C. 1991).
I don't think it was appealed by the government. In any case, it has not
been overturned. Whether it is consistent with the Supreme Court's
jurisprudence regarding permissible limits on free speech in government
grant awards is an unresolved question. Incidentally, Stanford vs. Sullivan
was concerned with HHSAR 352.224-70, not the clause (352.227-24) you
mentioned in your listserv posting.
