Removing HHSAR 352.224-70

I am negotiating a couple subcontracts which have prime SAMHSA & HCFA
contracts. They each contain the HHSAR clause 352.227-24, Confidentiality
of Information, which I haven't had to negotiate for awhile. Previously I
would ask it to be removed based on the fact that a federal district court
judge had declared this clause illegal. This is from a 1991 court
decision. Can anyone advise whether the decision was ever overturned, and
it is still an appropriate justification.
