As it has been explained to me by a couple of AOR-level people over the decades, the NICRA rate is the maximum you are legally allowed to request.

Good morning colleagues,

 

Does anyone with a negotiated indirect cost rate agreement for research (but *not* a non-research rate) have any experience with the use of the de minimis rate for non-research activities? Without naming names, I have noticed that at least one prominent research university (with a negotiated NICRA) does so when the federal sponsor does not mandate a rate on a non-research proposal. 

 

In other words, what does one do when a sponsor says the indirect rate is "unrestricted,"  but it's patently clear that the use of a research-burdened IDC rate would deem the application non-competetive? 

 

I have a general "gut" feeling on this as somewhat arbitrary, but would very much appreciate hearing from others.
