Hi Everyone,

I have a faculty member who was on a fixed term contract and set up an LLC once they left our institution. We would like to engage them on an international (non-federal project) through their single-member LLC. Since they were an employee here, our institution would prefer hiring them as a temporary employee rather than setting up an independent contractor agreement. This person will not be supervised and would be completing tasks on the project that were different than what they were doing while employed as a faculty member. Have any of you experienced an issue like this? Were you able to engage the former employee as an independent contractor? If so, how did you make that determination. Any advice is greatly appreciated.

Thanks,

Sarah
