I'm not an expert in this field, but the language from the company seems reasonable. While I certainly understand not wanting any restrictions on publications, students come and go. This language would protect both the facility and the school from a student "going rogue" and publishing something without anyone's knowledge, particularly after they have left the school or the study.

Colleagues,

I am working on an affiliation agreement to place our students in clinical rotations.  One site has indicated that they will not accept the following language (which I thought was a reasonable compromise):

The School shall inform students that they may not publish any material relative to their clinical learning experience unless advance written consent is obtained from both Facility and School, which consent will not be unreasonably withheld.  The School will cooperate with Facility, as necessary, to ensure that students do not publish material understand their obligation to provide any material relative to their clinical learning experience to Facility and School in advance of any publication. without Facility’s express written consent.

They are insisting on the following:

The School shall inform students that they may not publish any material relative to their clinical learning experience unless advance written consent is obtained from both Facility and School.  The School will cooperate with Facility, as necessary, to ensure that students do not publish material relative to their clinical learning experience without Facility’s express written consent.

I have been working hard to ensure that we’re not accepting any publication restriction language in any of our agreements, but they won’t budge and this is a major clinical site for us.  Any suggestions?  P.S.  As if I’m not asking enough for your opinions, this is, of course, highly time-sensitive.  I appreciate your replies!   Kirsten
