This is an interesting situation – very interesting! I agree that involving the PO and the GMS on the award is a good idea – they may have concerns they want answers or clarifications on. Some of my initial questions would be:

 

-          Why does he want to award to stay at the original institution for the first phase only? Depending on what is the reason, there could be some possible options. For instance, if he wants the award to stay at the original institution so a GRA can complete their work for their dissertation, then a subcontract back to the original institution could be done to allow the GRA to continue on the project (and thus no delay the grant transfer)

-          What physical resources or facilities will he be using for the first phase? I’m assuming his new institution would want to know if he is using any facilities at their location for the first phase (as they are basically covering the costs of the facilities on their own dime)

-          If he will be only part-time, does your institution have a policy on IP rights to cover him? If he is using the new institution’s facilities to complete the project (but the award stays at the old institution) – then this could possibly complicate IP ownership

 

I know this is more questions, rather than answers for you, but I’m not sure if this helps in thinking through some possible challenges or opportunities for your specific situation.

 

Lastly, if he will be moving to part-time status – will this change his level of effort? If yes and it is more than 25%, prior approval from NIH would be needed for that piece.

I’m hoping someone can point me to a resource to guide me through the requirements to transfer an award to another institution. I know about the basic relinquishment procedure, but this situation seems somewhat different in that the PI has requested that he remain a part-time employee of our organization (even after he starts work at the other institution) so that he can complete the first phase of his work on the award in question. He then wants to transfer the remaining three years of the award to the new institution.

 

I plan on consulting the program officer for this particular award but it would be great to have some background before that.
