Thanks everyone for your responses. Yes, FAR 16.2 is what we have to send and I’d seen that, but I’m afraid the folks who need to see this in the particular situation we’re dealing with likely won’t “get it”. That said, I just shot them the email containing that reference ;-) What the heck!

Does anyone know where within either circulars or FAR I can find clear definitions for these terms, i.e., specifically I want something that addresses the fact that an agreement is fixed price and the grantee doesn’t spend all and yet meets deliverables, they can keep it. I doubt there’s something like that really, but something that makes that clear. I’ve looked all over the place and can’t seem to find anything and I want it to come from some government source vs. me just stating the definition.
