Both must be new investigators.  We submitted such a grant and with both listed as new investigators, but later on found out that the collaborating PI had received a prior grant that precluded us from using the New Investigator tag.  (certain awards, such as K awards will allow a PI to retain New Investigator status).  If the collaborating PI would have been a New Investigator, the application would have been treated as such.
 
The SRA informed us that the application would go through as a regular R01.
