VCU is an instrumentality of the Commonwealth of Virginia.  By direction of the Attorney General of the Commonwealth, we are not allowed to contract that any party other than a court of competent jurisdiction may impose a binding decision upon VCU.  Accordingly, we have stricken the language referring to binding arbitration.
