Very interesting problem.  I would love to know who the contractor is.
I would certainly make some of my decisions based on the contractor's
business and reputation.  For instance, I would advise a faculty member
here to avoid the tobacco people entirely.  If it is Betty Crocker,
well, I would worry less. (coastal naivete, perhaps)

As far as I can see, and assuming that the publication being refered to
is something done after the deliverable is delivered, i.e., something
more academic, published for the usual academic reasons, the institution
cannot guarantee rebuttal.  The journals make decisions on whether to
run articles, and clearly an article with a nasty rebuttal attached will
alert the journal attorneys, which means in the end the right to
rebuttal will be a veto right.  Not acceptable.  If, on the other hand,
you have already identified the neutral media as, say, the U.I. Research
Results Annual, a slick coffee table item published at no cost to the
good citizens of Iowa, then consider whether you would want their
rebuttal in your brochure.  Depending on the circumstances, it might
