Yes I am aware that the Small Business must submit and the criteria. What I am asking is if a member of our institution starts up a business (not the PD) and that is the business we partner with is it problematic?

Hi Emily,
Are you aware this program is only available to small businesses.  Institution like yours would be a subcontract on the project.  Usually the PD/PI is a member of the small company, not from your institution, unless there is a special arrangement for your faculty to allow the appointment with the small company, which would mean the institution appointment would decrease.
Is this what you would like to do?

 We are attempting our first USDA SBIR grant. What have your PI' s done to meet the PD being employed at least 50 percent by the small business? Are they starting their own LLC or partnering with a community business? If they are starting an LLC what does the structure look like?
