We look at it the same way.  Below is how we explain it to campus.

The airline designator and flight number of the U.S. based airline should be reflected on the ticket:

Compliant: AA8902 operated by China Airlines
Incompliant: CI0007 operated by American Airlines AA = American Airlines, CI = China Airlines

I have always been told that as long as the ticket is issued by the US carrier, it doesn't matter who is operating the plane.

I would assume if the individual made their reservations through Delta that they are in compliance with the Fly America Act especially if Canadair is a partner.  I am flying to the UK.  I booked my reservations through United but part of my trip is on Lufthansa but I believe I am in compliance with the Fly America Act. Fellow Research Administrators,

I have a situation where a researcher on a federal grant flew to Hong Kong.  A few of the flights were "Delta" operated by "Comair" however the planes were Canadair.  Does this conflict with the Fly America Act?  We are having a debate here in our office.  I would greatly appreciate any insight.
