Re: ORCA Gregory K. Schmidt 17 Mar 2012 23:09 EST

What I find amusing - ok, not really - is that CFDA is a part of SAM. So why NOT the grants? CFDA has no part in contracts as they aren't "assistance" yet it is part of SAM. Alternatively, why have CFDA in SAM and not grants.gov or some other system?

When I'm elected Dictator...

CCR is required though, and this checklist has some helpful information on why/what/how. I would imagine that this checklist will be updated when SAM is deployed, and it will then direct grant applicants to create an account in SAM and then access the CCR module inside SAM. (That said, I have not had the time to read up on whether SAM is just combining multiple systems under a one-stop shop or whether the underlying regulations have changed as well.)

>The interesting question though is *why* wouldn’t ORCA be required for grants? Because the underlying terms and conditions found in your federal grant-based awards are not in the form of government acquisition clauses. (If you look at the incorporated grants policy statements or the terms and conditions in your grant-based awards, you will see lots of full-text clauses and CFR citations, but no FARs or DFARs or HUDARs. “HUDARs” is endlessly amusing to me for some reason …)

>In contrast, your federal contract-based awards (whether a prime contract directly with a federal agency or a subcontract with a prime contractor) are rooted in government acquisition clauses, and thus ORCA is a requirement if your entity wishes to receive such awards. ORCA was implemented back in 2005 to reduce the paperwork associated with the annual updating of a bundle of representations and certifications for contracts based on government acquisition clauses (for origin history please see the final rule published @ 69 FR 76345 amending FAR Part 4 Administrative Matters, Subpart 4.12 Representations and Certifications – guaranteed to cure insomnia).

It includes the CFDA, Fed Biz Opps, CCR, ORCA, EPLS, PPIRS (CPARS/FAPIIS), Wage Determination, FPDS, and eSRS so far. All under one login. As it stands now, there remains the multiple systems. Once SAM is operational there will be only one that is compartmented into the various sections.
