The concern of your IRB members is very appropriate.

Many universities' liability policies will cover IRB members, however state institutions may or may not be able to assure their members in writing - in particular their unaffiliated (community) members - that they will be defended.
This is definitely something to check out with your institution's legal counsel.

In thinking about this reply I did some research in the ultimate repository of wisdom and truth (Google) and came upon something called the Volunteer Protection Act of 1997. It would seem that it applies to IRB members...
