Attached is an institutional policy that worked well for a state
research university.
The reference to the Appropriations Act notes language in the annual
state appropriation; other institutions may have an external legal
requirement regarding F&A collection.
It is not explicitly stated in this policy, but was the practice
based on it, that F&A would never be waived on a project funded by an
industrial or for-profit sponsor.
Giving the institution's highest research executive the authority to
waive F&A (the exact wording related to the Appropriations Act
language) allows for flexibility, but in practice a waiver was never
given unless it appeared to be to the benefit of the University.
