Bill,
If the majority of your grant funding is from DHHS, you will negotiate a
rate with DHHS Division of Cost Allocation:
http://grants2.nih.gov/grants/funding/welcomewagon.htm#dca

If the majority of your grant funding is from DOD, you will negotiate
with DOD.

If majority of funding is from neither, the default agency is DHHS.
