I agree with you Chuck.  If you look at the appropriation language from Congress, it's a rate limitation.  The language says that you can't use NIH, AHRQ or SAMHSA appropriations to pay salaries on any extramural mechanism (so contracts are also included) "at a rate in excess of Executive Level I", which is now $171,900 per year.  To me, this is like the limitation on the daily rate for consultants on NSF funding--that's another appropriation language thing.

Salary beyond the cap is not an unallowable cost, it is an allowable cost
that the sponsor refuses to pay.  You can, and should, count it as
voluntary committed cost share.
