Re: Indemnification - Use of Results Colleen Corcoran 15 Aug 2002 08:48 EST

In clinical trials, we ask the Sponsor to "indemnify, defend and hold
harmless the RFMH..., against all suits, claims, demands or prosecutions
that may be brought or instituted, and all judgements, damages,
liabilities, court costs and expenses (including attorney's fees)
resulting, therefrom, based on or arising out of performance of the
Study and use of the product." Obviously our primary concern is that
someone might suffer an adverse event as a result of study
participation. However, we believe this language would cover the
Sponsor's use of the results, as well as many of those situations you
can't anticipate.
