subcontract term/conditions of award Nancy Schlesiger 09 Jan 2002 10:28 EST

Can anyone advise or direct me to a federal reference?  We (subcontractor)
are reviewing a proposed subagreement with a small public agency (sponsor)
that has an award from USDept of Labor.

1) Subcontract term extends for three months beyond the end date of the
sponsor's prime Dept of Labor award (grant ends 9/30; subcontract ends
12/31).  The agency will complete their payments to us by 9/30, but we have
some reporting requirements through 12/31 and they want the agreement to
cover that period also(?)  I believe the regs require that the subagreement
period mirror the prime award period--but I can't seem to put my fingers on
it. . .

2) The contract contains full fiscal penalty (repayment of the entire
budget) if the scope of work is not completed by 12/31.  Institutionally,
we don't plan to accept this condition, but I'm not sure if there also may
be a federal regulation I can cite. . .
